The Local Authority Agrees to Assess

Understanding what this means and how to make the most of this stage

What Does It Mean When the LA Agrees to Assess?

The Local Authority has agreed that your child may have special educational needs and may require support through an EHC plan, so they will now carry out an Education, Health and Care Needs Assessment (EHCNA).

This is a positive and important step – it does not guarantee that your child will receive an EHCP, but it means the LA recognises further investigation is needed.

​

Under Section 36(8) of the Children and Families Act 2014, the legal threshold for an assessment is low. It only needs to be “possible” that your child has SEND and “possible” that they may need provision through an EHCP. The LA has accepted that your child meets this threshold.

Once the assessment is agreed, the Local Authority has up to 16 weeks from the date of your request to decide whether to issue an EHCP
